The court of appeal may, at the request of a party or of its own motion, suspend the setting aside proceedings for a period to be determined by the court of appeal in order to enable the arbitral tribunal to eliminate the ground for setting aside by reopening the arbitral proceedings or by taking such other measure as the arbitral tribunal deems appropriate. No appeal shall lie against a decision of the court of appeal.
Before the arbitral tribunal decides, it shall grant the parties the opportunity to be heard.
If the arbitral tribunal is of the opinion that the ground for setting aside can be remedied, it shall render a corresponding arbitral award which shall replace the award of which the setting aside was sought.
After the suspension of the annulment proceedings, the court of appeal shall decide in accordance with what it deems appropriate, taking the circumstances into account.
Het gerechtshof kan, op verzoek van een partij of uit eigen beweging, de vernietigingsprocedure schorsen voor een door het gerechtshof te bepalen termijn om het scheidsgerecht in staat te stellen de grond tot vernietiging ongedaan te maken door het heropenen van het arbitraal geding dan wel door het nemen van een andere maatregel als het scheidsgerecht geraden acht. Tegen een beslissing van het gerechtshof staat geen hogere voorziening open.
Voordat het scheidsgerecht beslist, stelt het de partijen in de gelegenheid te worden gehoord.
Indien het scheidsgerecht van oordeel is dat de grond tot vernietiging ongedaan kan worden gemaakt, wijst het een dienovereenkomstig arbitraal vonnis dat in plaats komt van het vonnis waarvan vernietiging is gevorderd.
Na de schorsing van de vernietigingsprocedure, beslist het gerechtshof overeenkomstig hetgeen het, de omstandigheden in aanmerking genomen, passend acht.
