A petition for the annulment of the recognition made by the mother may, on the ground that the mother is not the biological mother of the child, be filed with the court:
by the child himself, unless the recognition took place during his majority;
by the recogniser, if she was induced to do so by threat, error, deceit or, during her minority, by abuse of circumstances;
by the other mother, if she has been induced to give consent to the recognition by threat, error, deceit or, during her minority, by abuse of circumstances.
Article 205, paragraphs 2 to 5 inclusive, applies mutatis mutandis to the annulment of the recognition.
Een verzoek tot vernietiging van de door de moeder gedane erkenning kan, op de grond dat de moeder niet de biologische moeder van het kind is, bij de rechtbank worden ingediend:
door het kind zelf, tenzij de erkenning tijdens zijn meerderjarigheid heeft plaatsgevonden;
door de erkenner, indien zij door bedreiging, dwaling, bedrog of, tijdens haar minderjarigheid, door misbruik van omstandigheden daartoe is bewogen;
door de andere moeder, indien zij door bedreiging, dwaling, bedrog of, tijdens haar minderjarigheid, door misbruik van omstandigheden bewogen is toestemming tot de erkenning te geven.
Op de vernietiging van de erkenning is artikel 205, tweede tot en met vijfde lid, van overeenkomstige toepassing.
