The application for the extension of the period of validity of the EU Blue Card may be rejected if:
the holder does not satisfy the conditions for the issuance of that card, as set forth in Article 3.30b, with the exception of the first paragraph, under d, e and h;
the holder does not comply with the restriction under which the permit was granted; or
no notification has been made as referred to in Article 4.43, unless the failure to do so did not reach the competent authorities for reasons beyond his control.
By way of derogation from the first paragraph and Article 3.4, third paragraph, the application for the extension of the period of validity of the European Blue Card shall not be rejected with the application of Article 18, first paragraph, under (d) and (f) of the Act on the ground that the holder is unemployed, unless the latter:
has been unemployed for more than three consecutive months and he has held a European Blue Card for less than two years; or
has been unemployed for more than six consecutive months and has been a holder of an EU Blue Card for at least two years.
By way of derogation from the first paragraph, the application for the extension of the period of validity of the EU Blue Card shall not be rejected with the application of Article 18, first paragraph, under (d) and (f) of the Act if the holder temporarily, and in any event for no longer than twelve months, does not satisfy these conditions as a result of illness, disability or parental leave and has not applied for a benefit pursuant to the Participation Act (Participatiewet).
Further rules regarding the application of the first, second and third paragraphs may be established by ministerial regulation.
De aanvraag tot het verlengen van de geldigheidsduur van de Europese blauwe kaart kan worden afgewezen, indien:
de houder niet voldoet aan de voorwaarden voor verlening van die kaart, zoals opgenomen in artikel 3.30b, met uitzondering van het eerste lid, onder d, e en h;
de houder niet voldoet aan de beperking waaronder de vergunning is verleend; of
geen melding is gedaan als bedoeld in artikel 4.43, tenzij het nalaten hiervan de bevoegde autoriteiten niet heeft bereikt om redenen waarop hij geen invloed heeft.
In afwijking van het eerste lid en artikel 3.4, derde lid, wordt de aanvraag tot het verlengen van de geldigheidsduur van de Europese blauwe kaart niet met toepassing van artikel 18, eerste lid, onder d en f van de Wet afgewezen op de grond dat de houder werkloos is, tenzij deze:
langer dan drie achtereenvolgende maanden werkloos is en hij minder dan twee jaar houder is van een Europese blauwe kaart; of
langer dan zes achtereenvolgende maanden werkloos is en hij ten minste twee jaar houder is van een Europese blauwe kaart.
In afwijking van het eerste lid, wordt de aanvraag tot het verlengen van de geldigheidsduur van de Europese blauwe kaart niet met toepassing van artikel 18, eerste lid, onder d en f van de Wet afgewezen indien de houder tijdelijk, en in ieder geval niet langer dan twaalf maanden, niet voldoet aan deze voorwaarden als gevolg van ziekte, handicap of ouderschapsverlof en geen uitkering krachtens de Participatiewet heeft aangevraagd.
Bij ministeriële regeling kunnen nadere regels worden gesteld omtrent de toepassing van het eerste, tweede en derde lid.
