If the youth or his parents so desire, the municipal executive (college) shall provide them with a personal budget (persoonsgebonden budget) that enables them to obtain the youth care belonging to the individual provision from third parties.
A personal budget (persoonsgebonden budget) shall be granted if:
the minor or his parents, in the opinion of the municipal executive, are sufficiently capable on their own of a reasonable assessment of the interests involved, or are capable, with assistance from their social network or from a curator (curator), administrator (bewindvoerder), mentor (mentor), authorised representative, certified institution or provider of closed youth care, of performing the tasks associated with a personal budget in a responsible manner;
the minor or his parents take the reasoned position that they do not consider the individual provision provided by a provider to be appropriate; and
it is ensured in the opinion of the municipal executive (college) that the youth care which forms part of the individual provision and which the youth or his parents wish to obtain from the budget, is of good quality.
By regulation, it may be determined under which conditions the person to whom a personal budget (persoonsgebonden budget) is provided may obtain youth care from a person belonging to the social network.
The municipal executive may refuse a personal budget:
insofar as the costs of obtaining youth assistance from third parties are higher than the costs of the individual provision, or
if the municipal executive has previously applied Article 8.1.4, paragraph 1, subparagraph a, d or e.
Indien de jeugdige of zijn ouders dit wensen, verstrekt het college hun een persoonsgebonden budget dat hen in staat stelt de jeugdhulp die tot de individuele voorziening behoort van derden te betrekken.
Een persoonsgebonden budget wordt verstrekt, indien:
de jeugdige of zijn ouders naar het oordeel van het college op eigen kracht voldoende in staat zijn tot een redelijke waardering van de belangen ter zake dan wel met hulp uit hun sociale netwerk dan wel van een curator, bewindvoerder, mentor, gemachtigde, gecertificeerde instelling of aanbieder van gesloten jeugdhulp, in staat zijn de aan een persoonsgebonden budget verbonden taken op verantwoorde wijze uit te voeren;
de jeugdige of zijn ouders zich gemotiveerd op het standpunt stellen dat zij de individuele voorziening die wordt geleverd door een aanbieder, niet passend achten; en
naar het oordeel van het college is gewaarborgd dat de jeugdhulp die tot de individuele voorziening behoort en die de jeugdige of zijn ouders van het budget willen betrekken, van goede kwaliteit is.
Bij verordening kan worden bepaald onder welke voorwaarden de persoon aan wie een persoonsgebonden budget wordt verstrekt, de jeugdhulp kan betrekken van een persoon die behoort tot het sociale netwerk.
Het college kan een persoonsgebonden budget weigeren:
voor zover de kosten van het betrekken van de jeugdhulp van derden hoger zijn dan de kosten van de individuele voorziening, of
indien het college eerder toepassing heeft gegeven aan artikel 8.1.4, eerste lid, onderdeel a, d of e.
